1. About this website

Welcome to guidedemploymentgroup.com (the “Site”). The Site is operated by Guided Employment Group Pty Ltd (ABN 54 618 169 350) (“Guided”, “we”, “us” or “our”), the corporate website for the Guided group of businesses, which includes GuidedTalent and GuidedEmployment (each a “Guided Business”).

By accessing, browsing or using the Site, you agree to be bound by these terms of use (the “Terms”). If you do not agree with the Terms, you must stop using the Site immediately.

We may review and change these Terms at any time by updating this page. Changes take effect from the date they are published.

2. Relationship to individual Guided Businesses

This Site provides general information about the Guided group. Where you engage directly with a specific Guided Business - for example, applying for a role through GuidedTalent, or booking a consultation through GuidedEmployment - that Guided Business’s own terms of use and privacy policy will also apply to that engagement, and take precedence over this Site’s Terms in relation to that specific service.

3. No fee to candidates

Across the Guided group, candidates are never charged for GuidedTalent’s recruitment services. If you are placed in a role by a GuidedTalent consultant with one of our paying clients, whether on a permanent, contract, or labour hire / on-hire basis, you will not be charged a fee for that placement - our fees are paid by the client, not the candidate.

If you have separately paid GuidedEmployment for a consultation or course and are subsequently placed in a role by a GuidedTalent consultant, that fee is refunded to you. See GuidedTalent’s and GuidedEmployment’s own Terms of Use for the full detail of how this applies.

4. Using the Site

You may use the Site to learn about the Guided group and its businesses, and to make general enquiries. You must not use the Site to:

• breach any other person’s privacy or legal rights;
• defame, harass, threaten or offend any person;
• interfere with any other person’s use of the Site;
• transmit viruses, malicious code, or attempt to tamper with, hack or disrupt the Site or its underlying systems;
• send unsolicited or bulk communications through the Site; or
• use the Site to compete with Guided’s business, or to scrape, harvest or extract data from the Site for a competing purpose.

5. Intellectual property

The Site and its content - including text, graphics, logos, design elements and the Guided brand family - are owned by or licensed to Guided Employment Group Pty Ltd and are protected by copyright and other intellectual property laws. We grant you a non-exclusive, non-transferable, revocable licence to access and use the Site for its intended purpose.

You must not reproduce, republish, distribute, modify or create derivative works from any part of the Site or its content without our prior written consent, except as reasonably necessary to view, save or print pages for your own personal or business use.

6. Privacy

Any personal information you provide through the Site is handled in accordance with our Privacy Policy, available on the Site, which also explains our use of cookies.

7. Links to other websites

The Site contains links to other Guided Businesses and to third-party websites. We do not control, endorse or take responsibility for the content, accuracy or practices of any linked website, and including a link does not imply our endorsement of it.

8. Disclaimer and liability

Nothing in these Terms limits or excludes any guarantee, warranty, representation or condition implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be limited or excluded.

Subject to that, the Site and its content are provided “as is” and “as available”, without warranty of any kind. To the maximum extent permitted by law, Guided (and its officers, employees, contractors and agents) is not liable for any loss or damage arising from or in connection with your use of, or inability to use, the Site.

To the extent permitted by law, Guided’s total liability arising out of or in connection with the Site or these Terms is limited, at our option, to re-supplying the relevant service or the cost of having it re-supplied.

9. Indemnity

To the maximum extent permitted by law, you indemnify Guided against any loss, damage, cost or expense arising from or in connection with your use of the Site or breach of these Terms.

10. Complaints

If you have a complaint about the Site, please contact us using the details in section 12 so we can investigate. If your complaint relates to how we have handled your personal information and you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC).

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute relating to these Terms is subject to the exclusive jurisdiction of the courts of New South Wales. If you access the Site from outside Australia, you are responsible for complying with the laws of your own jurisdiction.
